Terms of Service

Last updated: October 20, 2026

These Terms of Service ("Terms") govern your access to and use of Mimvello (the "Service"), an AI content manager that helps you create, adapt, schedule and publish social media content. By creating an account or using the Service, you agree to these Terms and to our Privacy Policy.

Mimvello is operated by Rijfrisjes, a sole proprietorship (eenmanszaak) established in the Netherlands. Throughout these Terms, "we", "us" and "our" refer to Rijfrisjes as the operator of the Service.

1. Who provides the Service

The Service is provided by Rijfrisjes, a sole proprietorship (eenmanszaak) established in the Netherlands, registered business address Tokyostraat 19 S, 1175 RB Lijnden, the Netherlands. Contact: Gouymimoun@gmail.com.

2. Your account

  • You must provide an accurate email address and are responsible for keeping your sign-in credentials secure. Activity that happens through your account is your responsibility.
  • You must be at least 16 years old and able to form a binding contract under applicable law to use the Service.
  • Each account is for one person or organisation. You may create multiple workspaces and brands within your account where the Service allows it.

3. Acceptable use

You agree not to:

  • Use the Service to publish content that is illegal, infringes others' rights, is deceptive, or violates the rules of any connected platform.
  • Use the Service to create or spread spam, misleading engagement, impersonations, malware or disinformation.
  • Attempt to access other users' data or workspaces, probe or disrupt the Service's infrastructure, or circumvent its limits and access controls.
  • Resell, sublicense or provide the Service to third parties as a competing offering without a separate agreement with us.
  • Upload content you have no right to use, including other people's videos, photos or music without permission.

We may suspend or restrict accounts that violate these rules, with notice where practicable.

4. Connected social platforms

  • Connecting a social media account happens only through the platform's official sign-in (OAuth). We never ask for your platform passwords.
  • By connecting an account you authorise us to use the platform access it grants — to verify the connection, publish content you approved or scheduled, and read data the permissions allow, such as analytics.
  • You are responsible for complying with each platform's own terms, developer policies and content rules. A platform may limit, suspend or remove our or your API access at any time; if that happens, affected features may stop working until access is restored.
  • You can disconnect an account at any time. Disconnecting stops publishing to that account but does not delete content already published by the platform.

5. Your content

  • You keep all rights to the content you upload, write and approve in the Service.
  • You grant us a limited licence to store, process, analyse and — solely as you direct — publish your content, and to transmit it to the platforms and AI providers described in the Privacy Policy, strictly to provide the Service.
  • You are responsible for the content you publish, including that you have the rights to it and that it complies with the law and each platform's rules.
  • When you delete content, it moves to a restorable state first so it cannot be lost by accident; you can remove it permanently.

6. AI-generated content

  • The Service uses AI to analyse your content and draft posts. AI output may be inaccurate, incomplete or unsuitable — you must review it before approving or publishing it.
  • AI suggestions are drafts for you. Nothing is published by the AI on its own: publishing requires your approval or a schedule you have set, within the automation limits you configure.
  • You are responsible for published content even if the wording was AI-generated. Subject to applicable law and to your ownership of your underlying content, AI-generated drafts you approve are yours to use.

7. Publishing and automation

  • The Service publishes posts through the platforms' official APIs using the access you granted. A post is only marked "Published" after the platform confirms it.
  • Publishing can fail for reasons outside our control — platform outages, revoked permissions, expired access, rate limits or removed media. When that happens we show the platform's error and give you a safe way to retry.
  • Automation features follow the limits you set. The Service will not publish content you did not approve or schedule, except as part of automation rules you configured.

8. Plans, trial and payments

  • Paid plans: Starter €19, Pro €49 and Business €99 per month. For consumers in the Netherlands these prices include 21% VAT. For other countries, any applicable VAT or sales tax is calculated at checkout based on your location; the total you will pay is always shown before you confirm.
  • New customers get a 7-day free trial. A payment method is required to start it. Unless you cancel before the trial ends, your paid subscription starts automatically at the end of the trial and you are charged the monthly price. The trial-end and first-payment dates are shown before checkout. One trial per customer.
  • Subscriptions renew automatically every month until cancelled. You can cancel at any time via "Manage subscription" on the Billing page. Cancellation takes effect at the end of the current trial or paid period; you keep access until then and are not charged again. Cancelling during the trial means you pay nothing.
  • Payments are processed by Stripe. Your checkout, receipt or invoice shows the party that issues it and any terms that apply to the payment.
  • We will announce price changes at least 30 days in advance. You may cancel before a new price applies.

9. Right of withdrawal (EU consumers)

  • If you are a consumer in the EU, you have the right to withdraw from the subscription within 14 days of concluding the contract, without giving a reason, by emailing Gouymimoun@gmail.com or cancelling via "Manage subscription".
  • Starting the free trial does not waive this right. If you withdraw or cancel during the trial, you pay nothing.
  • If you expressly asked for the paid service to start within the withdrawal period and then withdraw, you pay only a proportional amount for the period up to your withdrawal; any excess is refunded.
  • Other refunds are given where required by law.

10. Availability and changes

  • We may add, change or remove features, and will give notice of significant changes. We will not remove core features of a paid plan during a paid period without offering a proportional refund.
  • We do not promise uninterrupted or error-free operation. Maintenance, third-party outages or platform policy changes may interrupt the Service.

11. Termination

  • You may stop using the Service and request deletion of your account at any time.
  • We may suspend or terminate your account if you seriously or repeatedly breach these Terms, or where required by law or a platform, with notice where practicable.
  • On termination, connected social accounts stop being used immediately. Sections that should survive termination (ownership, disclaimers, liability) remain in effect.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, except those that cannot be excluded by law. We do not warrant that AI output is accurate, that publishing will always succeed, or that results (reach, engagement, performance) will follow from using the Service.

13. Limitation of liability

We provide the Service to support your own content and publishing decisions; we do not control the platforms you connect to, the content you choose to publish, or how a platform reacts to it. To the maximum extent permitted by applicable law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue, data or goodwill, arising from your use of the Service — including damage caused by an AI-generated draft you approved, a post that was not published, published twice or published at the wrong time, or a platform limiting, suspending or closing your account or API access.

For business customers, our total liability for any claim relating to the Service is limited to the amounts paid to us for the Service in the twelve months immediately before the event that gave rise to the claim. If you are a consumer, the limitations in this section apply only to the extent permitted by mandatory consumer law.

Nothing in these Terms limits or excludes liability that cannot be limited under Dutch law, including liability for intent or gross negligence, for death or personal injury, or for a defect we deliberately concealed. Mandatory rights you have as a consumer — including as a consumer in the European Union or the Netherlands — are not affected by this section.

14. Indemnification

You agree to compensate us for third-party claims arising from content you publish through the Service or from your breach of these Terms or of a platform's rules, except where the claim results from our breach of these Terms or our negligence.

15. Governing law and disputes

These Terms are governed by the laws of the Netherlands, without prejudice to mandatory provisions of the law of the country where you habitually reside — in particular mandatory consumer-protection and data-protection rules — which continue to apply and prevail where they are more protective than Dutch law.

Business customers agree that disputes are submitted to the competent court in the Netherlands. If you are a consumer, you may bring proceedings in the courts of your country of residence, and we can only bring proceedings against you there. EU consumers can also use the EU Online Dispute Resolution platform.

16. Changes to these Terms

We may update these Terms. If a change materially reduces your rights, we will notify you in the Service in advance. Continuing to use the Service after a change takes effect means you accept the updated Terms.
